MRP 346: Listener Questions August 2026

Can an adopted grandchild inherit mineral rights the same way a biological grandchild can? Will your Permian Basin lease ever see a second bench developed, or is one horizontal target all you’re going to get? And why does the number on your royalty check almost never match the production volume you pulled from the state’s own database? This month’s listener questions episode tackles all three, plus a practical walkthrough of how operators are stacking benches in the Permian and what that means for the long-term value of your minerals. Whether you’re trying to untangle an inheritance question, decide between a working interest and a royalty interest, or just make sense of the numbers on your check, this episode is here to help you get you unstuck.

As before, many of the questions in this episode are covered in more depth in my Mineral Management Basics online course, including how to read a legal description, perform a title search, identify nearby oil and gas activity, and determine whether you should be getting paid on a well.

Thanks again to everyone who left a review or who submitted a listener question! If you have a question about your minerals or royalties, you can send it to feedback@mineralrightspodcast.com!

Listener Question #1

My mother is a mineral owner.  I am trying to establish a paperwork trail of the properties involved so I can transfer the mineral rights into an LLC.  I am planning a trip to the county where the minerals are located to search property records.  I currently know of 3 properties but there may be others.  I also believe there may be a mistake in the records when it was passed to my mothers possession.  I will probably need a landman and attorney to get everything transferred and corrected.

Thank You

Scott

Listener Question #2

I am in the process of transferring some mineral rights and properties into my name, passed down from my mother. There have been several glitches in getting this accomplished, so I have been very frustrated. But I am hoping to successfully convert them soon. I am very new to the mineral rights community. When I have some money, I am definitely going to take your course, as I need to learn how this all works. Thank you for providing so much information to people. I can already tell you are a huge blessing!

Listener Question #3

Dear Matt,

I am curious to learn about operators drilling new benches in the Permian Basin. From well production on the Texas RRC website, it looks like operators are targeting the Sprayberry benches and the Wolfcamp benches. Our lease has 5 horizontal wells targeting the Sprayberry. Is it likely that the operator (Surge) will also develop the Wolfcamp bench on our lease? This is important in establishing the value of the mineral royalties.

Also, I have seen several of the leases in Howard County have production with a predictable decline curve, but then have a big jump in productivity. Is this due primarily to new wells being drilled?
As always, thank you,

Mark

Listener Question #4

How to find out if a plot of land in NW Arkansas has oil, gas, mineral interests and who owns? I have to plot description

Listener Question #5

Can  Birthright  mineral rights and land  rights be passed down to adopted child and continue succession to the next generation.

Thank You,

Huett

Listener Question #6

Hi,

My name is Timothy, I have oil rights in CO and need some help deciding if I want to be WI or RI involved. I’ve been using Google, but feel lost in making a decision for the potential income. I have the funds to be a WI owner, but want to make sure I’m making a good decision. Who do you recommend talking to in CO, or can you help me with that? Thanks again for your help.

Listener Question #7

Hi Matt and Justin!

I have a question.

I pulled the oil production and disposition data reported to the Texas RRC for our new well, and compared it to the production reported on our checks.  Before I call the operator, can you explain what the differences are between “Production” and “Disposition” reported to the state, and why that might be different from what I’m seeing on the check?  (Of course, the check is less…).  I’m guessing I need to do the same thing for the gas.

I did a quick search of your podcasts to see if this topic might have already been addressed, but didn’t see anything.

I’ve attached my excel spreadsheet for additional info —

Thanks!

Barb
